A California appeals court has rejected Elizabeth Holmes’ plea to overturn her 2022 conviction, which she is currently serving in a Texas federal prison. The disgraced Theranos founder was convicted of three counts of wire fraud and one count of conspiracy to commit wire fraud.
Holmes argued that the trial judge improperly allowed former employees to testify as expert witnesses, but the court ruled that their testimonies were based on personal experiences, not expertise. She also claimed that a report from the Center for Medicare and Medicaid Services misled the jury, but the judges dismissed this claim.
The denial of Holmes’ appeal means that her conviction is likely final. Neama Rahmani, a former federal prosecutor, says that Holmes only has one appeal as right, and this was it. Only a small percentage of appeals result in even a hearing.
