OpenAI Sues Elon Musk Over ‘Bad-Faith Tactics’

OpenAI has filed a countersuit against Elon Musk, alleging that he used “bad-faith tactics” to slow down its business and gain control over cutting-edge AI technology. The move opens up a new front in the ongoing battle between two Silicon Valley giants.

Musk sued OpenAI CEO Sam Altman last year to stop him from changing the company’s corporate structure. The countersuit claims that Musk tried to manipulate OpenAI’s business to benefit himself, rather than advancing its mission as a non-profit organization.

The dispute centers around OpenAI’s conversion from a non-profit to a for-profit company, with Musk claiming it strayed from its founding mission and therefore breached contract. However, OpenAI denies this, saying Musk has been spreading false information about them.

The case raises questions about the motivations of both parties, with some experts describing it as a battle over control and revenue. The trial is set to take place in March 2026, with US District Judge Yvonne Gonzalez Rogers expected to preside over the proceedings.
