Sean “Diddy” Combs’ lawyers are laying groundwork for his defense, arguing that he’s not guilty of federal sex crimes because he was engaging in consensual but non-monogamous behavior known as swinging. The term was used by Combs’ attorney Marc Agnifilo during a court hearing on April 25, less than two weeks before Combs’ trial begins on May 5.
Swinging is a lifestyle where singles or partners in committed relationships engage in intimate acts. Combs’ lawyers want to portray his activities as part of this lifestyle to demonstrate that he didn’t have the criminal intent required to be guilty. However, federal prosecutors allege that Combs engaged in more sinister behavior, including sex trafficking and racketeering.
Combs has been charged with two counts each of sex trafficking and transportation to engage in prostitution, as well as one count of racketeering. He has pleaded not guilty to all five counts. The case emerges amidst a series of civil lawsuits from dozens of accusers who accuse Combs of a pattern of sexually and physically abusive behavior over several decades.
Combs’ lawyers have maintained his innocence through the legal team, with the attorney indicating that Combs had rejected a plea deal. A hearing is scheduled for May 1 to question Combs directly about the offer.
