Nintendo has filed a lawsuit against accessory maker Genki, claiming trademark misuse and misleading marketing.
Genki showcased unofficial mockups of the Nintendo Switch 2 at CES 2025, sparking attention from fans, reporters, and news outlets. However, this surprise moment turned into a controversy after Nintendo accused Genki of using its trademarks without permission and making false claims to promote its products.
Nintendo is suing for trademark infringement, unfair competition, and false advertising, both under federal and California state law. The company believes Genki used its “Nintendo Switch” and “Joy-Con” trademarks in ways that made their products appear officially approved or connected to Nintendo.
Genki’s CEO showed off the mockups and discussed confidential designs of the unreleased console, which was not true. Nintendo had only shared official details on January 16, followed by a full presentation on April 2.
Despite this, Genki continued to use Nintendo’s marks and designs in its videos, social media, and marketing. The company announced its own event called “Genki Direct” and streamed a presentation that looked similar to Nintendo’s, featuring renders and opening pre-orders for its Switch 2 accessories.
Nintendo is seeking to stop Genki’s marketing and sales tied to the Switch 2, destroy any products or ads using Nintendo trademarks, hand over profits made from related sales, cover damages, and legal fees. The company also wants a permanent injunction that would prevent Genki from continuing this kind of behavior.
This lawsuit could be headed for a public showdown unless the two companies settle out of court.
