Harvey Weinstein Trial Hit with Juror Misconduct Concerns

Jurors in Harvey Weinstein’s New York retrial have sent multiple notes expressing concerns about the fairness of the trial. The defense team has pointed to possible juror misconduct, claiming that some jurors are discussing uncharged crimes and elements of Weinstein’s past. Despite these concerns, Judge Curtis Farber denied a motion for a mistrial.

Weinstein faces charges of rape and criminal sexual acts, with prosecutors seeking to prove his relationship with the complaining witnesses. The prosecution has been allowed to ask about unwanted sexual encounters outside of the charged crimes, but this is not being used as evidence of Weinstein’s propensity to commit crimes.

The jury has also sent a note requesting the testimony of key witnesses again, including Miriam Haley, Jessica Mann, and Kaja Sokola. One juror expressed concerns that other jurors were discussing another juror in the courtroom elevators, but was denied permission to step down from the jury.

Weinstein’s 2020 conviction was overturned in April 2024 due to improper rulings, including allowing women to testify about allegations not part of the case. The trial has lasted six weeks and included testimony from over 20 witnesses.
