Columbia Sportswear Sues Columbia University Over Trademark Infringement

Columbia Sportswear has filed a lawsuit against Columbia University, alleging trademark infringement, unfair competition, and breach of contract. The sportswear company claims the university breached an agreement not to use its “Columbia” name alone on apparel merchandise.

According to court documents, the two parties entered a written agreement in 2023 stating that the university could use the “Columbia” name with another distinguishing mark associated with the university, such as its shield or lion mascot logo. However, Columbia University’s webstore recently sold shirts and hats bearing only the word “Columbia,” which attorneys for the sportswear company argue violates this agreement.

Columbia Sportswear is seeking a jury trial, monetary damages, and the removal of any infringing products from the university’s inventory. The brand also claims that the use of Nike and Champion logos on the apparel creates customer confusion, associating it with its competitors rather than itself.

The lawsuit was filed in the US District Court for the District of Oregon and is likely to be settled out of court. However, if Columbia Sportswear’s version of events is disputed by the university, it could lead to a more complex case.
