A federal judge has dismissed a lawsuit by Spencer Elden against grunge rock band Nirvana for the second time. The lawsuit claimed that the band’s 1991 album cover, featuring a naked baby (Elden) swimming towards a dollar bill on a fishhook, was child pornography. However, US District Judge Fernando Olguin found no evidence to support this claim, comparing the image to a “family photo of a nude child bathing”. The judge dismissed the lawsuit, saying that it was without merit and did not meet the definition of child pornography under the law.
