Top authors are suing OpenAI over its use of their novels to train its artificial intelligence chatbot, ChatGPT. A federal judge has limited the scope of their case, dismissing a claim accusing OpenAI of unfair business practices without consent or compensation.
The writers’ main claim for direct copyright infringement remains unchanged. The court previously dismissed other claims and allowed the unfair competition law claim to proceed. However, OpenAI successfully challenged the authors’ revised complaint, arguing that the Copyright Act preempts state law claims relating to copyrighted works.
The authors claimed that OpenAI unfairly used their books without permission. Since the allegedly infringed materials are copyrighted, the court concluded that any claims should be under the purview of copyright law. The judge noted that attempting to amend the claim would be futile.
OpenAI faces multiple legal battles over its use of published works to train ChatGPT. Trade groups, artists, and publishers have also sued the company.
