A federal appeals court has ruled that US President Donald Trump’s administration cannot deploy the National Guard in Illinois. The Chicago-based 7th Circuit Court partially upheld a lower court ruling that blocked the deployment, citing concerns of civil unrest and potential conflict.
The decision was related to Operation Midway Blitz, launched by the Trump administration in September to detain and deport undocumented migrants in Illinois. Local officials had sued the administration, arguing that the deployment was a “grave intrusion on Illinois’ sovereignty.”
In contrast, when President Joe Biden took office, he has not sent National Guard troops to any Democratic-led cities without local opposition or lawsuits.
The court order states that members of the National Guard do not need to return to their home states unless further ordered by a court to do so.
