Appeals Court Scolds Trump Admin Over Deported Man’s Case

A federal appeals court sharply criticized the Trump administration’s handling of a deported man’s case, citing rule of law concerns. The 4th Circuit Court called the administration’s stance ‘shocking’ regarding Kilmar Abrego Garcia’s deportation.

The court emphasized Abrego Garcia’s right to due process despite administration claims he is a gang member. Judges warned of dangers from the escalating conflict between the executive and judicial branches over the case.

In a blistering order, the three-judge panel refused to suspend a judge’s decision to order sworn testimony by Trump administration officials to determine if they complied with her instruction to facilitate Abrego Garcia’s return.

The court emphasized that this case presents an opportunity for the government to vindicate its commitment to the rule of law. The judges stated that if the government is confident in its position, it should be assured that position will prevail in proceedings to terminate the withholding of removal order.

President Trump was asked about Abrego Garcia’s right to due process but ducked the question, saying he would refer to his lawyers. Administration officials claim they lack the authority to bring back Abrego Garcia from El Salvador, citing a mistake in his deportation.

However, the Supreme Court has already ruled that the government must work to bring him back. The 4th Circuit panel concluded that Abrego Garcia deserves due process, even if the government connects him to a gang.
