Attorneys for Man Accused of Gunning Down CEO Say Prosecutors Wrongfully Obtained Medical Records

Attorneys for Luigi Mangione, the man accused of gunning down UnitedHealthcare CEO Brian Thompson last December, claim that Manhattan prosecutors wrongfully obtained his medical records from Aetna.

In a new court filing, Mangione’s attorneys allege that the Manhattan District Attorney’s Office obtained over 120 pages of information about his medical history, including diagnoses and specific complaints, without the court or defense team’s knowledge. The prosecution allegedly compelled Aetna to turn over the documents directly to its office, bypassing the usual court process.

The defense argues that the information obtained by prosecutors is not relevant to the state’s criminal case. Mangione faces the death penalty in federal court for murder and other charges related to Thompson’s death.

Mangione has pleaded not guilty to all federal and state charges against him. His diary entries, which include references to “delay,” “deny,” and “depose” on bullets found at the scene, have been used as evidence in his case.

The defense is seeking access to communications between Aetna and the District Attorney’s Office and has requested an evidentiary hearing. Prosecutors claim that they deleted the materials after becoming aware of them and informed the court and defense team about the mistake.

Mangione’s medical history, including a back surgery and spondylolisthesis, was not related to his alleged motive for killing Thompson. The defense letter says that prosecutors partially reviewed Mangione’s confidential doctor-patient privileged and HIPAA-protected medical records.
