California Bar Exam Troubles: Probe Underway as Applicants Sue Test Admin

The State Bar of California is launching a forensic investigation into the leak of its new exam questions, which were posted online shortly after the test’s launch on February 25. The probe comes amid widespread criticism and numerous complaints from examinees about issues with proctors, connectivity, and submission problems.

Meanwhile, a group of applicants has filed a class-action complaint against ProctorU Inc., alleging that the vendor failed to administer the test smoothly through its Meazure Learning unit. The complaint claims that the test-taker’s experience was “traumatized” due to technical issues caused by Meazure.

The state bar had initially planned a makeup exam on March 3 and 4 but has since postponed it to March 18 and 19, citing a need to address the exam questions and reconfigure the test. Those involved in sharing the exam questions could face strict sanctions, including revocation of moral character or denial of licensure.

The issues with the new exam were motivated by an anticipated $3.8 million deficit, which led the state bar to move away from the National Conference of Bar Examiners-created exam to a hybrid, two-day test. Deans of California law schools have expressed concerns about the development process and are seeking remedies.

As the situation continues to unfold, applicants will continue to test through Saturday before registration dates for the July bar exam are announced. The state bar has apologized for the alignment issues between their information and Meazure Learning’s and is offering free retakes for those who fail the February exam.
