DHS Revises TPS for Haiti Designation Period

US Citizenship and Immigration Services (USCIS) has announced a partial vacatur of the 2024 Temporary Protected Status (TPS) decision for Haiti, reducing the designation period from 18 months to 12 months. The new TPS extension will expire on August 3, 2025.

The redesignation was made by DHS Secretary Kristi Noem, who cited national security concerns and changing conditions in Haiti as reasons for the change. The initial registration period for new applicants remains in effect until August 3, 2025.

Employers and federal, state, and local government agencies are required to update their records to reflect the new expiration date of August 3, 2025, for Haiti TPS-related documents. If an employer or agency receives a valid Employment Authorization Document (EAD) with a TPS category code that was set to expire on February 3, 2026, they must record the earlier expiration date.

DHS originally designated Haiti for TPS in 2010 following a devastating earthquake and has since redesignated and extended the program multiple times. The most recent designation allowed Haitian nationals to file initial applications if they were residing in the United States as of May 21, 2021.

The next steps will involve DHS Secretary Noem reviewing the current conditions in Haiti at least 60 days before the end of the current extension period and announcing a decision regarding the extension or termination of TPS for Haiti by June 4, 2025.
