Getty Images Sues AI Company Over Copyright Infringement

Getty Images is suing Stability AI in the UK for copyright infringement over its popular AI image-making tool Stable Diffusion. The trial began on Monday and could last for three weeks. Stability’s tool was released in 2022, just months after OpenAI’s surprise hit chatbot ChatGPT.

Getty claims that Stability used its AI model without permission to create photorealistic images, stating that it involved “brazen infringement” of Getty’s photography collection. The company argues that creators should be asked for permission before their works are fed into AI systems, rather than an “opt-out regime”.

Stability’s lawyers say that Getty’s claims represent a threat to the AI industry and that only a tiny proportion of its outputs resemble Getty’s works. The case could test whether AI companies can use large amounts of copyrighted material without permission.

The trial is expected to have implications for the commercial negotiations between content creators and AI developers, as well as for the wider generative AI industry.
