Krasner Sues Musk Over $1M Daily Giveaway to Pennsylvania Voters

Philadelphia District Attorney Larry Krasner has sued Tesla CEO Elon Musk and his America PAC over a $1 million daily giveaway to voters in swing states, including Pennsylvania. The DA claims the promotion is an illegal lottery that violates state consumer protection laws and lottery regulations.

Krasner testified that he would have sued pop star Taylor Swift if she conducted a similar giveaway, despite his own affiliation as a Democrat. He also stated that he drives a Tesla and has had one since 2016. When asked if he would have sued Musk if he were backing Kamala Harris instead of Donald Trump, Krasner said yes.

Musk’s America PAC has maintained that the giveaway is not an illegal lottery because it does not offer a prize to be won but rather sets up contractual obligations for participants to serve as spokespeople. However, attorney John Summers representing Krasner’s office called this “a flat-out admission of liability” in the lawsuit.

Krasner argues that Musk and his PAC are aware they are conducting an illegal lottery despite claiming it is a legitimate promotion. The DA has asked for an injunction to stop the giveaway, which awards $16 million to date.
