Mangione’s Lawyers Claim DA Office Violated HIPAA in Accessing Health Records

Luigi Mangione’s defense team claims the Manhattan District Attorney’s Office illegally accessed his private health records, violating federal law HIPAA. In a new court filing, prosecutors used a “false and fraudulent” subpoena to obtain documents from Aetna without a court order or consent.

According to the filing, the DA’s office pressured Aetna into handing over documents, warning it would face contempt of court if it didn’t comply. Mangione’s lawyers are now seeking a formal evidentiary hearing on the matter and possibly sanctioning the DA’s office.

The charges against Mangione, accused of murdering UnitedHealthcare CEO Brian Thompson, remain pending despite his defense team’s arguments about double jeopardy and unconstitutional prosecution. A judge will decide whether to grant the request for a hearing on the alleged HIPAA violation.
