Oreo Maker Sues Aldi Over Packaged Copycats

Mondelēz International, the maker of popular snack brands such as Oreos and Chips Ahoy, has filed a lawsuit against Aldi, alleging the supermarket chain copied their packaging designs for various products. The civil complaint claims Aldi’s actions are “likely to deceive and confuse consumers” and dilute Mondelēz’s unique product branding.

Aldi is accused of copying packaging for Oreos, Wheat Thins, Nutter Butters, Chips Ahoy, Nilla Wafers, Ritz, Teddy Grahams, and other snack products. The lawsuit seeks monetary damages and a court order requiring Aldi to stop selling products with infringing packaging.

Mondelēz claims it has previously contacted Aldi on multiple occasions about the issue, but the supermarket chain continued to sell similar products. However, some of these products were discontinued or changed after Mondelēz brought them to Aldi’s attention.

Aldi previously faced a lawsuit from Hampden Holdings over copyright infringement related to their Baby Bellies snack puffs. In that case, federal courts ruled in favor of Aldi, dismissing the allegations.

The dispute highlights ongoing trademark and branding disputes between major companies and discount supermarkets like Aldi.
