Oreo Sues Aldi Over Alleged Cookie Copycatting

Mondelez International, the maker of Oreos, Chips Ahoy, and other popular cookies and crackers, has filed a lawsuit against Aldi in Illinois federal court. The company claims that Aldi’s store-brand cookies and crackers are “blatant copies” of Mondelez products. Mondelez alleges that Aldi’s packaging and product designs are likely to deceive consumers and dilute the distinctive quality of Mondelez’s iconic product packaging.

The lawsuit states that Mondelez has contacted Aldi multiple times about the similarities in packaging and requested that the supermarket chain stop its “unlawful infringement.” Although some changes have been made, the company claims that Aldi continues to sell products with similar designs. As a result, Mondelez is seeking monetary damages and a court order to prevent further infringement.

Aldi has faced several other legal battles over packaging in recent months, including a dispute with Thatchers’ Cider over its cloudy lemon cider trademark and an earlier case involving Hampden Holdings’ products. The company has yet to respond to the latest lawsuit, but the case is ongoing.
