The US Supreme Court has rejected President Donald Trump’s bid to resume quick deportations of Venezuelans under an 18th-century wartime law. The decision, made with over two dissenting votes, bars the administration from quickly removing Venezuelan men who have been designated as gang members from the country.
The ruling comes in response to an emergency appeal from lawyers for these individuals, who claim that being labeled a “foreign terrorist organization” and invoking this 1798 law unfairly restricts their right to due process. The court has extended its previous prohibition on deportations from a north Texas detention facility under this law.
The decision is the latest setback in Trump’s efforts to speed up deportations of people in the country illegally, who he claims did not follow US immigration laws. This marks another judicial challenge to the administration’s use of an old law to target specific groups.
Several cases related to the invocation of this 1798 law are currently being litigated in lower courts, with at least three federal judges having ruled that Trump was improperly using this law to accelerate deportations of people deemed Venezuelan gang members.
