A California judge reopened a defamation complaint against Tesla and its CEO, Elon Musk, after a whistleblower, Cristina Balan, alleged the company fired her for raising safety concerns about its vehicles. Balan, who has stage-3B breast cancer in remission, claims she was let go in 2014 after warning Musk about a design issue that could affect braking.
According to Balan, she sent Musk an email identifying hundreds of defects per car, but Tesla’s HR and legal departments forced her to resign rather than addressing the issues. She alleges that 90% of workers who expressed concerns to Musk were fired shortly after.
Balan previously prevailed in a wrongful termination dispute against Tesla and has now won another attempt at her defamation lawsuit. However, a contract she signed while working at Tesla may postpone the case through arbitration. Balan fears not having a day in court due to her health struggles.
