Tribes Seek Delay in Supreme Court Hearing on District Lines

Changes are possible in the district lines around Belcourt and Devils Lake as tribes prepare for a potential Supreme Court hearing. The Turtle Mountain Band of Chippewa and Spirit Lake Nation sued the state in 2021, arguing that the creation of a subdivision in Belcourt diluted their representation and voting power. A U.S. District Court Judge agreed in 2023, forcing lawmakers to redraw the map.

However, the Eighth Circuit Court of Appeals reversed this decision in May 2023, which could lead to the original 2021 map being reinstated. The tribes are asking for a delay in this ruling, fearing that if it is granted, several lawmakers may no longer be in their original district. If the ruling is delayed, Rep. Kathy Frelich (R-Devils Lake) says she will have to take action to address the impact on her district’s representation.

The Supreme Court hearing is expected within two weeks, and Legislative Management has already expressed a desire to hold another meeting after the decision is released to discuss its effects. The outcome of this case could significantly alter the region’s legislative landscape.
