The revised order finds credible evidence suggesting that U.S. Steel might take action that threatens national security through the proposed acquisition. It also states that provisions of law do not provide adequate authority to protect national security in this matter. However, the revised order adds that threatened impairment to national security can be mitigated if certain conditions are met.
The new order amends certain sections of the initial order and authorizes CFIUS to implement measures, including monitoring and enforcement actions, to protect national security. It also reserves Trump’s authority to issue further orders with respect to U.S. Steel or Nippon Steel as necessary.
The revised order will be published in the Federal Register, and a copy will be transmitted to the parties involved in the proposed transaction.
