US Supreme Court to Weigh Trump’s Passport Policy for Transgender Americans

The US government has asked the Supreme Court to block passports that reflect the gender identities of transgender and nonbinary Americans, challenging a federal judge’s order that bars enforcement of a policy by former President Donald Trump. The policy requires passports to accurately reflect an individual’s biological sex classification.

In April, US District Judge Julia Kobick issued a preliminary injunction in Boston after six transgender and nonbinary individuals sued the government over the policy, which they claimed was arbitrary and rooted in prejudice against transgender Americans. The judge found that the policy violated their equal protection rights under the US Constitution.

The Trump administration has argued that the judge’s order has no basis in law or logic and claims the policy is “eminently lawful.” Justice Department lawyers say the government has the constitutional power to communicate with foreign governments using accurate sex designations on passports.
